Argument/Rebuttal to Thesis

Some may dispute this claim by adding that these high incarceration rates may be as a result of other socio-economic factors such as poverty and illiteracy. As The Guardian said, “numerous factors contributing to the imbalance of convictions, including racial profiling and poverty” (Cecco, 2020). Using the barriers as a means of justification for the imprisonment of indigenous Canadians has served as a means by which the government attempts to mask their problems. In another article by the National Post, Andrew Coyne argues that attempting to correct this issue by ensuring that there is an indigenous perspective within the courtroom is ineffective. He argues that most cases have nothing to do with Aboriginal rights and as such should be judged without such a precedent. However, due to the enormous pressure on the judge, he will be forced to rule in line with what may be called an “aboriginal orthodox” (Coyne, 2005)
